Police say they have records showing that Jacqueline Lavigne and a 17-year-old male student chatted via BlackBerry Messenger in the fall of 2011, but don’t know exactly what was said.
Waterloo Regional Police Sgt. Eugene Silva testified Thursday at the sexual exploitation trial of Lavigne, who is accused of having sex with the student during the same period of time she was teaching him at Monsignor Doyle Catholic Secondary School.
She has pleaded not guilty.
Silva testified that after police initially retrieved text messages between the two from the student’s BlackBerry, a software update pointed them to three new exchanges.
Among those chats, court heard, were one in which the student wrote “Fail me and I’ll tell” and LAvigne responded “Then do some work.”
Another exchange which began a few days later, began with the student asking Lavigne what he had said the previous day.
The court was told that Lavigne responded “You asked would I hook up,” and – categorizing the student as “extremely drunk” – said she chose not to respond.
About a week later, Lavigne was arrested and charged.
The Crown wrapped up its case against Lavigne Thursday.
A decision on whether Lavigne will testify in her own defence is expected Friday morning.
