A 44-year-old man who was attacked at an Allen Street home in Waterloo Sunday has died of his injuries.

The man has been identified as Bryan Warren Foy, a resident of Waterloo.

Police say Foy was attacked early Sunday morning in the home. When officers arrived, they found him with severe head injuries.

He was taken to Grand River Hospital in critical condition and died of his injuries Monday evening, after more than 24 hours on life support.

Family friend Colleen O’Toole says Foy loved his dogs, and had a special love for his two daughters, one son and one grandson.

“He really was the Crocodile Dundee of the family, with a heart as big as the sky,” she tells CTV.

A Waterloo father and son, 46-year-old Arthur O’Connell and 19-year-old Patrick O’Connell, were arrested and initially charged with aggravated assault. Police say those charges will now be upgraded to second-degree murder.

“Police continue to investigate this case, which has turned from an assault investigation into a homicide investigation,” says police spokesperson Olaf Heinzel.

Police say all three men knew each other and the attack was not random.

“We’re not able to get into the specifics of that relationship,” says Heinzel.

A post-mortem examination on Foy will take place Tuesday in Hamilton.

Foy was a father of three children. His family says he was the kind of person that helped everybody and loved his dogs, and asks for privacy.

Officers are expected to remain at the Allen Street residence through Wednesday. Phone directories list an A. O'Connell as a resident of the home.

The two suspects will appear in court Thursday.
