A Kitchener teen is going to prison for a New Year's Eve killing.

18-year-old Ryan Bates has been sentenced to ten years for manslaughter and aggravated assault.

Bates stabbed 60-year-old John Ferreira seven times.

Family and friends of both the victim and accused were in court when the sentence was handed down.

"It's been a long year and we've had a lot of support from our family and friends to help us through this process" says Ferreira's daughter, Amy Banwell.

"After all is said and done, we miss our dad and know that he will be looking out for us as we move forward with our lives."

Ferreira and his son were walking along the Iron Horse Trail, not far from his home, when he was confronted by Bates and a 16-year-old youth.

After a verbal exchange, Bates stabbed Ferreira seven times. His son was knifed in the neck.

The judge called it an act of brutal violence.

Bates was 17 at the time of the attack. He was given a 10-year, three month term, less 15 months credit for time already served.

Bates was just six days shy of his 18th birthday and was sentenced as an adult.

Bates will serve all his time in a federal penitentiary. The judge rejected a defence request that at least a portion of the sentence be served in a youth facility.

"We are relieved he will be spending his sentence in an adult facility and clearly the youth system was not enough for him to change his ways" says Banwell.

Crown prosecutor Mark Poland, had argued for federal time, in a case difficult for all concerned.

"There are no winners in a case like this. This is a tragedy all around. A 60-year-old man of our community has lost his life, another man was stabbed and a young man, who was 17 at the time, is now going to the penitentiary for a very, very, long time."

The youth, who was 16 at the time, was sentenced to time served for assault. There was no evidence he knew Bates had a knife.
