An 11-year-old alleged victim testified at the sexual assault trial of Daniel Magda, and the number of possible incidents is complicating the matter.

Magda, 37, has already admitted to assaulting the boy and another child, who are now five- and 11-years-old. They were three and 10 when the incidents occurred.

He has pleaded guilt to four charges of making child pornography and three sexual-assault related charges, but not guilty to 10 other charges. Additional charges have been dropped.

The boy testified from a separate room on Wednesday, with only a support worker and the two lawyers present. The testimony was transmitted via video to the courtroom.

The boy admitted that he gave differing accounts of how many times he was assaulted during separate police interviews.

In the first two interviews he agreed he told detectives he had been assaulted by Magda once. However, in the third interview he said it had happened seven or eight times.

That may be an issue says defence attorney Bruce Ritter, “It’s going to be the number of times the incidents happened, wherein the incidents happened and the frequency.”

The boy also testified that he was really happy that Magda was behind bars.

In 2007, Magda was convicted of assaulting three boys and sentenced to two years behind bars, but was released after less than a year.

The mother of one of the victims in that case has been in court to offer support and hopes there will be stronger consequences.

Debbie Farrow says “That he’ll be kept in jail for a longer period of time and maybe get some rehabilitation. I don’t know if that’s possible but definitely keep him off the street.”

Magda’s record may come into play in the sentencing phase of the trial, and could involve a dangerous offender application.

The trial resumes in July.
