A London, Ont., man who admitted killing his lover with a butcher knife will be getting a new trial.

The Ontario Court of Appeal set aside Melvin Flores' second-degree murder conviction and ordered a new trial.

In a decision released Monday, the court found that errors in instructions to the jury in Flores' 2007 trial justified a new hearing of the evidence.

Flores admitted killing Cindy MacDonald in June 2006, but said he was provoked, drunk and didn't mean to kill her, and his lawyer is arguing for a manslaughter conviction.

Flores said he "lost control" after MacDonald told him she'd aborted a child he'd fathered and was likely pregnant by her new lover.

Flores called police after the killing and officers found MacDonald's partially clad body -- with nine stab wounds -- in her backyard with the knife protruding from her back.
