Kelly DaCosta is still fighting a battle to restore his real estate licence – and he now faces criminal charges in an unrelated matter.

DaCosta, a prominent Waterloo Region real estate agent, is charged with assault and mischief following an incident that allegedly took place earlier this month.

A charge of harassment was dropped Thursday.

“There was no offence like that committed,” his lawyer, James Marentette, tells CTV News.

Last summer, DaCosta’s license was revoked by the Real Estate Council of Ontario following an anonymous complaint.

According to the tribunal, DaCosta allegedly committed inappropriate transactions at three homes he was selling in Cambridge between 2007 and 2010, breaching professional obligations in exchange for personal gain.

DaCosta successfully appealed the revocation of his licence. A new hearing was ordered, and took place in February.

A decision stemming from that hearing is expected in the next few weeks.

“We’ll wait for the decision and see whether he gets his licence back,” says Marentette.

The next criminal court date for DaCosta, who has been a registered agent since 1989, is set for May 8.
